Roof Terraces

The roof terraces (the “Roof Terraces”) are appurtenant to Units 202, 204, 205, 206, 207, 210, 301, 302, 303, and 304 (collectively, the “Roof Terrace Apartments”) located on the second and third floors of the building. The Roof Terraces are structurally roof systems and damage or penetration of their surfaces will allow water intrusion and leaks.

Owners of the Roof Terrace Apartments must ensure that the Roof Terrace surfaces are protected from damage and penetration. Also, Owners are responsible for the actions of their tenants and guests with regard to these surfaces.

The Roof Terraces are Limited Common Elements, as defined in and governed by the Master Deed and are required to be maintained and repaired by the FSHA, although they are used exclusively by the Owners of the Roof Terrace Apartments. As a result, the following regulations are necessary to ensure the watertight integrity of the building

Items Permitted on the Roof Terraces

  1. Appropriate, well-maintained, and reasonably sized patio/outdoor furniture limited to chairs, couches, tables and small chests. The colors must be white, black or neutral earth tones such as browns or grays in keeping with the exterior appearance of the building. No outdoor furniture is permitted that has metal feet that could pierce the Roof Terrace surface
  2. The Roof Terraces may have plant containers (on wide, rubber-wheeled casters). Plants can be no taller than 12-inches above the top of the wrought iron railing or a maximum of 52-inches for any plant. FSHA Board approval is required of all containers before they are placed on the Roof Terraces for aesthetic consistency to enhance the overall appearance of the building
  3. Each unit may have a table umbrella: the anchor base of the umbrella must be rubber or plastic, and must sit on a platform with wheels so that it does not touch the roof surface and can be moved easily; when the table umbrella is not in use, it must be closed and tied down for safety (to avoid the possibility of becoming airborne).

Items Prohibited on the Roof Terraces

  1. No furniture with metal feet that could pierce the surface of the Roof Terrace
  2. No permanent or semi-permanent structures, such as walls or pavers
  3. No gas or charcoal grills, hibachis, fire pits or open fires, appliances, propane or butane tanks, lanterns, torches, lit candles, electric extension cords, or similar items
  4. No water fixtures including birdbaths, fountains, or other similar items
  5. No storage containers, picnic coolers, water storage containers, and similar items
  6. No water hoses (when watering plants or foliage with watering can, water must not cascade below and watering can must stay inside the unit)
  7. No enclosures, awnings, shutters, screens, shades or similar fixtures attached to, hung in, or used in connection with the Roof Terrace
  8. No laundry, including clothes, bathing suits, towels, clothes lines, drying racks, rugs, or bedding items
  9. No garbage or trash of any sort whether loose or in containers or bags
  10. No bird or animal feeders or other items related to pets, including crates, litter boxes, or animal bedding
  11. No recreational equipment including bicycles, swings, tricycles, or similar items
  12. No interior household items, including but not limited to pots, pans, brooms, mops, buckets, cleaning supplies
  13. No objects or debris of any type may be thrown, dropped, or swept off the roof/terrace
  14. No indoor-outdoor carpeting
  15. No item may be hung from or affixed to the wrought iron railings (except during month of December for holiday lights and with Board approval)
  16. No outdoor decorations (except during month of December for holiday lights and with Board approval)
  17. No items that could be blown off in a high wind and cause damage or injury.

The FSHA staff shall access to the Roofs Terraces for routine maintenance and repair. It will be necessary that the staff periodically enter unitson the 2nd & 3rd floors to access gain access to the Roofs Terraces. Every effort will be made to notify the Owner at least 24 hours in advance when such Access is necessary, except in case of emergencies.
