Pets Rules (revised 8/26/20)

Pursuant to Section 10 of the Master Deed of Fort Sumter House Association, the Owners of units at the Fort Sumter House are granted certain rights and covenants that run with the land. These rights and covenants are detailed in Exhibit F to the Master Deed and include the right to keep household pets in owners’ units. This right, however, is subject to reasonable rules and regulations to govern the common areas with regard to pets as follows:
General Limitations
Owners are restricted to two (2) resident, household pets per unit. Each pet is limited to 45 pounds, for units on floors 2-7. Pets must be registered with the Fort Sumter House Association. All pets must be in compliance with local ordinances regarding registration and inoculations, proof of which may be required at the time of registration with Fort Sumter House Association. (Fish are considered common household pets, but a tank size of larger than 30 gallons requires the prior written permission of the Fort Sumter House Association.)
Owner to Control Pets
Pets must be under the owner’s control at all times, must be held or restrained on a leash in close proximity to the owner’s body and not be on a fully extended leash within the building interior common areas, including hallways and elevators.
Only Incidental Passage in Common Areas
Pets shall not be allowed in the common area with the exception of incidental passage. Pets are not allowed on the furniture in the common area.
No Unreasonable Disturbances
Pets shall be controlled so as not to create a nuisance or unreasonable disturbance. In the event a pet creates a nuisance or unreasonable disturbance and said pet’s owner does not remedy the situation within a reasonable time after notice in accordance with the FSHA Enforcement Procedure, said pet shall be removed from the property upon seven (7) days written notice from the Association.
Dog Friendly Park For Exercise and Relief
Pets must not be allowed to urinate on the pavement or in the garden area of the Fort Sumter House Association grounds. Owners must remove any pet waste promptly from the property. For your convenience, there are doggy waste stations with complementary bags across the street in White Point Gardens. Additionally, dogs can be off leash in White Point Gardens to run and play before 9:00am and after 5:00pm.
Indemnification of FSHA and Clean Up
All owners shall indemnify the Fort Sumter House Association and hold it harmless against any loss or liability of any kind or character whatsoever arising from having any animal on the property, including but not limited to reimbursement of carpet cleaning expenses required beyond the regular semi-annual cleanings. Pet owners will also clean up after pets, including but not limited to removal of paw prints, nose smears and “accidents”. If a pet accidentally takes “relief” in the interior of the building (i.e. hallway, elevator, etc), the owner must clean the area immediately, just as one would do in their own home. Additionally, the owner must notify the Manager.
Disposal of Cat Litter
Used cat-litter must be disposed of by double-bagging and placing into the trash chute room on your floor. Do not place litter into the trash chute because the bag can break at bottom of the chute, creating a cleanup problem.
Pets of Guests
Pets of guests must meet all the same restrictions regarding size and behavior as resident pets. Residents are responsible for compliance with the restrictions of their guests’ pet and inform their guests of the rules for the pets. Pets of guests that do not meet the requirements for weight and behavior established in these rules will not be permitted and will be asked to leave the property. Pets of contractors and workers are not allowed on the property.
Dangerous Animals Prohibited
No animal of any kind that has venomous or poisonous defense or capture mechanisms will be allowed on the property. Any animal with an aggressive temperament shall be prohibited from the property including, but not limited to aggressive dog and cat breeds and species. In addition, undesirable behavior of any animal by biting or attacking another dog or person will be sufficient reason to have that animal prohibited.
No Pets Maintained for Commercial Purposes
Pets may not be kept, bred or maintained for any commercial purpose.
No Pets To Be Kept by Tenants
Tenants are prohibited from keeping pets in units at the Fort Sumter House. Owners shall prohibit their tenants from keeping a pet in their unit.
